There have been several cases recently which have defined our interpretation of the rules in respect of selection and award criteria, in particular the Lianakis case. Other cases, in particular the Newham case, have defined our interpretation of the disclosure requirements for selection and award criteria, sub-criteria and their respective weightings.
What do the public sector regulations say, and do these cases change our interpretation, or simply clarify the regulations? Are the rules for the open procedure different to those for the two-stage procedures? What is good practice in order to avoid challenge?
